Terms of Use

1. General Provisions

These Terms of Use (hereinafter: 'Terms') govern the rules of access and use of the Smarenta online platform, including the website, CRM tools, and related digital services.

By using the Smarenta platform, the user confirms that they have read these Terms, understood their content, and accepted them in full. If the user does not agree with these Terms, they must cease using the platform.

2. Smarenta Platform Status

Smarenta is an online platform and software as a service (SaaS) that provides: property management tools, CRM functionality, the ability to publish information about properties for rent, and related digital services.

Important: Smarenta is not a party to rental/lease agreements concluded between: property owners, managers or agencies, tenants or travelers.

Smarenta does not act as an agent, intermediary, or representative of any party, does not guarantee the conclusion or execution of agreements, and is not responsible for relationships and obligations between platform users.

3. Platform Users

Platform users can be:

• travelers
• tenants
• individuals – property owners
• legal entities – property landlords
• managers/administrators
• system administrators

The platform provides different types of user accounts (owner, manager, user, admin) with different access levels.

Registration and use of the platform is permitted only for persons over 18 years of age.

4. Registration and User Account

To use the platform's functionality, the user must create an account and provide accurate and up-to-date information.

The user is responsible for safeguarding their login credentials and all activities performed through their account.

Smarenta reserves the right to temporarily or permanently restrict access to an account or delete it in case of violation of these Terms or applicable laws.

5. User Obligations

The user undertakes to:

• provide truthful information
• use the platform in accordance with the law
• not violate the rights of third parties
• not publish illegal or harmful content

It is prohibited to:

• use the platform for fraudulent purposes
• interfere with or abuse the system
• unauthorized access to Smarenta's technical infrastructure

6. Paid Services and Subscriptions

Smarenta may offer free and paid functionality, including subscriptions to CRM services.

Important note on billing: Smarenta charges exclusively for CRM subscription usage. Smarenta does not charge guests for rentals and does not participate in settlements/payouts between guests and accommodation providers; all such transactions are carried out by users independently outside the platform.

The terms of paid services, prices, payment method, and subscription cancellation are governed by a separate document: Subscription Terms / Public Offer.

Payments are made through third-party payment providers/banks (NLB e-commerce / Bankart gateway). Smarenta does not store users' payment card data.

7. Intellectual Property

All platform elements (software, design, interface, texts, databases) are the intellectual property of Nova Sidera D.O.O. or are used lawfully. Copying, distribution, or use without written consent is prohibited.

8. Limitation of Liability

The platform is provided 'as is'.

Smarenta is not responsible for user actions, accuracy or legality of listings, or for damages arising from agreements between users.

Smarenta's total liability is limited to the amount actually paid by the user for platform services in the last billing period.

9. Personal Data

Personal data processing is carried out in accordance with the Privacy Policy, which is an integral part of these Terms.

10. Termination and Cancellation

The user can delete their account at any time.

Smarenta may block access in case of Terms violation or to protect the system.

11. Applicable Law and Disputes

The law of Montenegro applies.

Disputes are resolved in competent courts in Montenegro, unless mandatory regulations stipulate otherwise.

12. Changes to Terms

Smarenta may amend the Terms. The current version is always available with the date of the last update.
